These Terms and Conditions (“Terms”) govern your access to and use of the frequency.media website, platform applications, and associated services (collectively, the “Services”) provided by Frequency, Inc. (“Frequency”, “we”, “us”, or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Acceptance of Terms

By using the Services, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

2. SMS and Text Messaging Program

If you opt-in to receive text messages from Frequency, the following terms apply:

  • Program Name: Frequency Text Messaging Program
  • Program Description: Frequency may send transactional and promotional text messages, including account alerts, billing updates, notifications, and marketing communications.
  • Message Frequency: Message frequency will vary based on your interaction with our Services.
  • Pricing: Message and data rates may apply. Check with your mobile carrier for details on your specific plan.
  • Opt-Out: You may cancel the SMS service at any time. Just reply STOP to any text message you receive from us. After you send the SMS message “STOP”, we will send you a final message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
  • Help/Support: If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or contact our support team at privacy@frequency.media.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.
  • Privacy and Data Sharing: As stated in our Privacy Policy, mobile information, including originator opt-in data and consent information, will not be shared with, sold to, or conveyed to any third parties for marketing or promotional purposes.

3. User Accounts and Registration

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date. You are responsible for safeguarding your password and for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Services to:

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. FREQUENCY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, FREQUENCY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

7. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page with a revised “Last Updated” date. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in New York.
